1. The Defendants shall jointly and severally pay to the Plaintiff KRW 40,000,000 and the interest thereon from March 3, 2016 to the date of full payment.
According to the records in Gap evidence No. 1, (1) around January 31, 2016, Defendant B decided to pay 70 million won to the plaintiff by dividing it from the end of February 2016 to the end of November 2016, and Defendant C jointly and severally guaranteed it; and (2) the plaintiff agreed to pay the due date for the remainder of 60 million won to the defendants on March 3, 2016 after receiving KRW 10,000 from the defendants on December 28, 2016 (the plaintiff was to be paid interest rate of 25% per annum from March 3, 2016) and (4) The plaintiff after preparing the above agreement, it can be acknowledged that the plaintiff received KRW 20,000 from the defendants.
Therefore, the Defendants are jointly and severally liable to pay to the Plaintiff the remainder of 40 million won (=70 million won - 10 million won - 20 million won) and interest and delay damages calculated by the rate of 25% per annum from March 3, 2016 to the date of full payment.
Thus, the plaintiff's claim of this case is accepted on the ground of the reasons.
