1. The defendant is based on the sale on June 6, 1990 as to each land listed in the separate sheet Nos. 1, 2, and 3 to the plaintiff.

Reasons

1. Facts of recognition;

A. Division and merger process 1) Non-Party B’s site, etc. is the deceased C (hereinafter “the deceased”).

(2) Of the 4,440 square meters of D orchard, the 2,177 square meters owned by the deceased was divided into “E” on April 27, 1990. 2) On September 11, 1990, the 1,506 square meters of F before the race-si owned by the deceased was divided into the 97 square meters before F. 97 square meters (the land indicated in paragraph (2) of the attached Table), G 286 square meters before G, and H 223 square meters.

3) Of E-U.S. 2,177 square meters, 44 square meters was divided into “I” on December 23, 1991. On January 3, 1992, E-U.S. 2,13 square meters and G previous 286 square meters were combined, and at the same time, the land category of 3,018 square meters was changed into a site on October 12, 1996. (4) On October 12, 1996, D orchard 2,263 square meters and 274 square meters (attached Form 3) were divided into four lots, including 274 square meters before K, and on the same day, L1,610 square meters and 292 square meters owned by the Defendant (attached Table 4) were divided into four parcels, including M. 292 square meters (attached Table 4).

5) Before H on January 12, 2006, the size of 607 square meters was changed on two occasions.

B. On June 6, 1990, the Plaintiff divided the land indicated in paragraph (1) of the attached Table No. 114 square meters before N. N. In order for the Defendant and the Plaintiff to implement apartment construction projects with 180 square meters above 2,263 square meters prior to the division, on two occasions, on the 99 households on the 1,610 square meters prior to the division, and on the 1,610 square meters prior to the division, on the 1,300 square meters prior to the division, the Defendant first transferred the registration of transfer in the Plaintiff’s future. ② The sales price shall be KRW 80,000 per square meter for the site area in actual use, and the intermediate payment shall be KRW 10,00 (150,000,000) for the Defendant as the down payment, and the intermediate payment shall be divided into the Plaintiff’s sales price and KRW 25,000,000,000 for the remainder payment to the Defendant.

2. On August 23, 1990, the Plaintiff is F, D and J. before the split-off.
