1. The Defendant’s KRW 25,00,000 as well as 5% per annum from March 18, 2014 to August 18, 2015 to the Plaintiff.
1. Indication of claim: The Plaintiff’s loan of 25 million won to the Defendant on March 4, 2014 (the repayment date March 17, 2014)
2. Applicable provisions of Acts: Article 208 (3) 2 of the Civil Procedure Act (Judgment on deemed as private capital);
3. Partial term portion: The Plaintiff sought payment of damages for delay calculated at the rate of 5% per annum from March 17, 2014 to the delivery date of a copy of the complaint in this case, and 20% per annum from the next day to the date of full payment. However, damages for delay with respect to the loan in this case shall accrue from March 18, 2014, the next day of the due date. Thus, the Defendant shall order the Plaintiff to pay the damages for delay calculated at the rate of 5% per annum under the Civil Act from March 18, 2014 to August 18, 2015, the date of this decision, and 20% per annum from the next day to the date of full payment, and the damages for delay in this case shall be dismissed.
