On April 30, 2014, the Defendant was sentenced to 10 months of imprisonment for fraud at the Suwon District Court. On November 7, 2014, the Defendant had a total of 52 criminal records, including the termination of the enforcement of the sentence in the Chungcheong detention house.

Criminal facts

1. On May 29, 2015, the Defendant: (a) around 11:55 on May 29, 2015, in the “Epiced” operated by the victim C, a member-gu, Ansan-si, Gyeonggi-do, under the influence of the victim C, as if he would normally pay the fee for the use of a computer on a normal basis; (b) visited the Internet after joining the said employee on a 31-site basis; and (c) purchased food worth KRW 8,500, such as fruit, cupbed, and am, from the said employee.

However, the Defendant did not possess cash or a credit card or other means of payment at the time, and did not have an intention or ability to pay the price even if he was using and being provided with an excessive person, because he was under the circumstances of moving the room to the room and living without a certain residence or place of work.

The Defendant was granted the right to use the above computer No. 31 from the above worker at the time, and used the above computer for 60 hours to 10 minutes, and did not pay the user fee and the food cost received.

As a result, the Defendant, by deceiving the above employee, acquired property benefits equivalent to KRW 72,200 using the computer, and received property equivalent to KRW 8,500.

2. On June 7, 2015, around 05:40 on June 7, 2015, the Defendant: (a) committed “HPC bank” operated by the Victim F in G in Si-si in Gyeonggi-do; (b) as if the Defendant would normally pay for the fee for the use of a computer from the said employee I; and (c) accessed the Internet on the 24th page by obtaining the right to use a computer from the said employee of Silsi.

However, the defendant does not possess cash, credit cards, or other means of payment at the time, and does not have a fixed residence and workplace.
