The prosecution of this case is dismissed.
Reasons
1. On July 22, 2018, the Defendant was under influence of alcohol, and around 00:10 on July 22, 2018, in front of Gwangjin-gu Seoul Special Metropolitan City, the Defendant used the victim C (31 knee, knee, knee, knee, knee, with the victim’s right edge, without good cause.
2. Determination
(a) Crimes of non-violation of intention: Article 260(3) and (1) of the Criminal Act;
B. On September 29, 2018, the victim, after filing a prosecution, expressed his/her intention not to punish him/her.
(c) Judgment dismissing a public prosecution: Article 327 subparag. 6 of the Criminal Procedure Act;
