1. The instant lawsuit was concluded on January 16, 2020 as deemed the withdrawal of the lawsuit.
2. The costs of the lawsuit after the completion of the lawsuit.
The facts that the Plaintiff was notified of the legitimate date for pleading but did not appear and make a statement on the third date for pleading held on October 17, 2019, the first date for pleading opened on November 7, 2019, the second date for pleading opened on November 7, 2019, and the third date for pleading opened on January 16, 2020, and the facts that the Defendant did not appear and make a statement on the said date for pleading are apparent.
According to the above facts, since the plaintiff and the defendant were absent on three occasions even after being notified of lawful date, the lawsuit of this case was terminated on January 16, 2020 by deeming the withdrawal of the lawsuit of this case in accordance with Article 8(2) of the Administrative Litigation Act and Article 268(3) and (2) of the Civil Procedure Act.
Since the plaintiff's litigation relationship is unclear, such as submitting an application for designation, etc., a declaration of termination of litigation shall be made in order to clarify that the lawsuit in this case is terminated.
