1. The defendant,

A. The plaintiff A, B, C, D, E, F, G, H, H, J, K, L, M, M, N,O, P, Q, Q, M, T, U, M, M, X, Y, Z, AAB, AC, AC, AD, AE, and AE.

Reasons

1. Facts of recognition;

A. The defendant is a corporation established pursuant to the Act on the Establishment and Operation of National Institute of Ecology, and the plaintiff AS, AT, and AU are those who retired while serving as the defendant's employee, and the remaining plaintiffs are currently serving as the defendant's employee.

B. The Defendant employees are divided into a senior position, a responsible position, a senior position, a senior position, and a senior position or lower, and all the Plaintiffs are employees below the senior position.

In order to prescribe matters concerning the remuneration, other benefits, etc. of executives and employees, the defendant has a provision on “compensation regulations” and “Rules on Enforcement of Remuneration Regulations”.

On April 29, 2016, the Defendant implemented the performance-based annual salary system only for employees of at least responsible level prior to the amendment of the remuneration regulations, while implementing the performance-based annual salary system for employees of at least appointed level.

On April 29, 2016, before the amendment of the remuneration regulations on April 29, 2016, the former part of the remuneration regulations was amended, and thereafter the fixed annual salary system for executive officers subject to the fixed-amount annual salary system is amended, the chief salary, the responsible salary, the responsible salary, the selection and appointment salary system subject to the appointment salary system, and the original salary below the original salary.

C. The Defendant paid an amount calculated by adding various allowances to “basic allowances” to employees subject to the salary grade system, based on the difficulty of duties, degree of responsibility, period of service, etc. (Articles 3 and 5 of the Remuneration Regulations). The Defendant paid as remuneration the sum of the basic annual salary (amount paid based on the individual’s career, accumulated performance, degree of difficulty and responsibility of class or duty) for employees subject to the performance-based annual salary system, job pay (amount paid based on the relative value of each duty, such as the importance and difficulty of duties, risk, etc.), and performance-based performance-based incentives (amount paid based on the results of evaluation of performance of duties, etc. in the preceding year).
