B On November 10, 2010, the Gwangju District Court sentenced 6 months of imprisonment with labor for a violation of the Waste Management Act, etc., and completed the execution of the sentence on October 18, 2013, on July 5, 2012, the Suwon District Court sentenced 10 months of imprisonment with labor for a violation of the Waste Management Act, etc., and completed the execution on October 18, 2013.
1. Defendant A and Defendant B are the representative director of the P Co., Ltd. located in Jinnam-si, and the person operating the said two companies while serving as the auditor of the company located in Gyeonggi-si Q. Defendant B is the father of Defendant A and jointly operated the said C and D as Defendant A. Defendant C was the person who jointly operated the said C and D. Defendant C for the purpose of producing fertilizers (livestock manure manure) and excreta recycling business. Defendant C was respectively incorporated for the purpose of producing fertilizers and livestock excreta.
(a) A person who intends to recycle wastes to a non-licensed waste treatment business shall submit a business plan to the Mayor/Do Governor, and obtain permission for a waste treatment business (waste recycling) by meeting the requirements for facilities, equipment, technical capability, etc. according to the business plan examined by the Mayor/Do Governor;
Nevertheless, the Defendants conspired to engage in recycling business with approximately 5,637 tons of total industrial wastes, such as 1,013 tons, 3,533 tons from H, and 1,091 tons from F 2 factories, and 5,637 tons from F 3 factories, and 1,091 tons from the site of the said C Co., Ltd., after receiving a commission from the competent authorities to enter them in the site of the said C Co., Ltd., and without obtaining a license for waste treatment business from the competent authorities, by mixing them with heavy equipment.
2) Any person who intends to treat wastes flowing into the public water zone for industrial purposes.
