C, D, E, and joint criminal acts committed an act in collusion with a person who, from around 2015, committed a crime of telephone finance fraud by deceiving a large number of unspecified persons by calls to investigation agencies or lending institutions by misrepresenting himself/herself, and so-called “ Bosing,” and, as the case requires, a borrowed account (the so-called passbook) to commit a criminal act, by misrepresenting the lending institution to access the persons who need the lending, thereby obtaining his/her access to the lending institution, and by allowing the fraudulent victims to withdraw the money through the delivery of the passbook, and then to transfer the money to the access medium acquired as above, and then allowing the defrauded victims to withdraw the cash.

피고인은 C으로부터 노트북과 차명 휴대전화를 제공받아 사용하면서 ‘ 큐 큐 (QQ)' 메신저를 통해 C이 접근 매체를 수령할 장소 및 전달할 장소를 지정하면, 피고인은 택배기사로부터 접근 매체 등을 전달 받아 C이 지정하는 곳으로 퀵 서비스를 통해 배송해 주는 방법으로 범행에 가담하였다.
