1. The Defendant’s KRW 35,223,200 and the Plaintiff’s annual rate of KRW 6% from December 17, 2016 to January 20, 2017.
The Plaintiff is a merchant engaging in the livestock product distribution business. The Defendant is a merchant engaged in food distribution business in the name of “B,” and the Plaintiff is obligated to pay to the Plaintiff damages for delay calculated at the annual rate of 15% as prescribed by the Act on Special Cases concerning the Promotion, etc. of Legal Proceedings from the following day to the day of full payment, on December 16, 2016, as there is no dispute between the parties to the livestock products amounting to KRW 35,223,200. The Defendant is obligated to pay to the Plaintiff damages for delay calculated at the rate of 35,223,200 per annum and 6% per annum as prescribed by the Commercial Act from December 17, 2016 to the day of full payment.
Therefore, the plaintiff's claim is reasonable, and it is decided as per Disposition by admitting it.
