However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

1. On December 201, the defrauded entered into a contract with the victim C on “One parcel outside D, Ulsan-gun, Ulsan-gun, Ulsan-do,” which read that the Defendant would handle the design and construction permission of the above ground building with the victim, and would receive KRW 8 million as the down payment from the victim, KRW 5 million as the down payment, KRW 11 million as the permit receipt, and KRW 24 million as the total amount from the victim.

On December 27, 2011, the Defendant stated to the effect that “the Defendant shall start design business. It shall send eight million won, which is promised as down payment, to the victim.”

However, in fact, the defendant did not actually intend to perform the above design work, and there was no intention or ability to return money even if he received money from the victim because he planned to use the money from the victim as debt repayment or cost of living.

The Defendant received KRW 28,200,000 from the victim to the Defendant’s account on the same day, and received KRW 28,200,000 from the victim to May 28, 2013, including the transfer of KRW 8 million from the victim to the Defendant’s account, and received property by deceiving the victim.

2. As stated in paragraph 1, the Defendant: (a) was delegated by C with the design and construction permit-related work; (b) did not intend to proceed with such work; and (c) did not actually proceed with the said work; and (d) was urged by the victim to demand whether the building permit was granted; (c) had the intent to forge the relevant official document regarding the building permit.

On May 18, 2012, the Defendant deleted the content of the list of building permits in the name of the head of Ulsan-gu, Ulsan-gu, Ulsan-gu, under the name of the head of Si/Gun (construction and 31152) (owner E) that was obtained prior to using the “Pototool” program from the PC located in the New-dong, Ulsan-gu, Ulsan-gu. < Amended by Act No. 11488, May 18, 2012>
