1. The defendant shall pay 192,00,000 won to the plaintiff and 18% per annum from August 5, 2010 to the day of complete payment.
1. Facts of recognition;
A. On August 13, 2008, the Plaintiff leased KRW 8.2% per annum on August 13, 2011, and KRW 192 million per annum on condition of the rate of delay interest, and completed the registration of the establishment of a mortgage over KRW 249.6 million with respect to the Songpa-gu Seoul lending Co. 302 (hereinafter the above lending referred to as “instant lending”) owned by A as a security, with respect to the above lending No. 302 of Songpa-gu Seoul lending (hereinafter the “instant lending,” and No. 302 of the above lending lending, hereinafter the “instant secured real estate”).
B. On January 2002, 101, 201, 202, 202, 301, 301, 401, and 402, total of 6 households were registered in the building ledger. On the building ledger, A-owned buildings were 301, 302, and 302 were not existing in the process of registration of ownership preservation. However, in the process of registration of ownership preservation, 101, 201, 301, 301, 302, 202, 301, 302, 302, 302, 401, 402, and 402, 302, were applied for registration of ownership preservation, and the registration of ownership preservation was completed, and there was no 302, 302, as the real estate register was registered.
C. On April 8, 201, the Plaintiff filed an application for a voluntary auction of real estate (Seoul Eastern District Court C) with respect to the instant secured real estate on April 8, 201, and on December 1, 2011, the execution court issued an order of correction to submit a building ledger or a survey result on the instant secured real estate, but failed to perform this order, and the said decision of voluntary auction was revoked.
On August 6, 2013, the Plaintiff again filed an application for the auction of the instant real estate (Seoul Eastern District Court D) with respect to the instant secured real estate. The Plaintiff was ordered by the executing court to revise the building ledger of the instant loan by dividing No. 201 and No. 201 on the building ledger into 201 and 301 on the building ledger, and correcting No. 301 on the building ledger by 302 on the building ledger.
