1. 경범죄처벌법위반 피고인은 2013. 11. 21. 01:20경 술에 취한 채 인천 남구 C에 있는 D 지구대에서 핸드폰과 차량 열쇠를 도난당했다고 신고하여, 현장에 출동한 경장 E, 순경 F으로부터 위 물품들이 피고인이 방문한 계양구 G에 있는 H 노래방에 있다는 것을 확인받게 되자, 경찰관들에게 위 장소까지 순찰차로 데려다 달라고 하고, 경찰관들이 데려다 주지 않는다는 이유로 “씹할놈들의 짭새 새끼들아, 일을 이따위로 하니까 너희들이 국민들에게 욕을 먹는 거다. 매일 순찰차량에서 잠이나 퍼 자고 말야.”라고 욕설을 하며 사무실에 비치된 전화기 선을 잡아당기는 등 술에 취한 채로 관공서에서 몹시 거친 말과 행동으로 행패를 부리고 주정을 하며 소란을 피웠다.

3. 공무집행방해 피고인은 03:20경 위 장소에서 소변을 보아 바닥에 고이게 한 뒤 경찰관들에게 “씹할놈, 짭새 새끼들아, 내 좆에서 나온 오줌이나 맛을 봐라”라고 욕을 하며, 바닥에 고인 소변을 발에 묻혀 걷어차는 등의 방법으로 경장 E, 순경 F의 얼굴과 근무복 등에 소변이 튀게 하는 등 폭행하여 경찰공무원인 경장 E, 순경 F의 정당한 직무집행을 방해하였다.
