A. The Plaintiff and the Defendant’s partnership business 1) The Plaintiff and the Defendant make an investment in each of KRW 70 million to KRW 75 million to operate a golf practice range. On November 27, 2013, the golf practice range located in Daegu Northern-gu D (hereinafter “instant golf practice range”).

(2) On December 9, 2013, the Plaintiff and the Defendant entered into a lease agreement with the lessor E on the instant golf driving range building with a deposit amounting to KRW 20 million and KRW 2 million per month on rent.

3) On December 6, 2013, the Plaintiff withdrawn KRW 70 million from a bank. Among them, KRW 20 million was paid to E as the above lease deposit, and KRW 50 million was paid to C as premium. 4) On December 13, 2013, the Plaintiff and the Defendant drafted a joint contract to confirm that each of the instant golf driving range is KRW 75 million (per 50% equity interest) and opened the business with the trade name “F” on December 27, 2013.

B. At around 23:00 on February 5, 2014, the Defendant’s indecent act against the Plaintiff: (a) told the Plaintiff at the instant golf driving range; (b) heard the words that the Defendant would return the investment money from the Plaintiff; (c) led the Plaintiff to an indecent act; and (d) led the Plaintiff to the office, leading the Plaintiff into the office, leading the Plaintiff to an indecent act; and (c) led the Plaintiff’s body, flading the Plaintiff’s neck and the Plaintiff’s neck away from the office; and (d) flading the Plaintiff into the office; and (e) flading the Plaintiff’s body, flading the Plaintiff into the body to gather; and (e) flading the Plaintiff into force; and (e) flading the Plaintiff into the Plaintiff’s chest, the Defendant was forced to commit an indecent act; and (e) flading the Plaintiff’s chest, at the same date and place as above, at the Plaintiff’s chest.
