1. The Defendant: (a) against the Plaintiff Company A, KRW 2,816,00, and KRW 2,971,000 to the Plaintiff Company B; and (b) against each of the said money.

Reasons

1. Basic facts

A. The Plaintiff Co., Ltd. (hereinafter “Plaintiff A”) completed registration of preservation of ownership of multi-household housing in the instant case on October 31, 2014, as the owner of the instant multi-household building D, E, and F ground G buildings (hereinafter “multi-household housing in this case”).

B. On November 18, 2014, Plaintiff B, the spouse of Plaintiff A’s representative director and the owner of the first Dong of the main building I (hereinafter “studio of this case”), who completed registration of the preservation of ownership as to the studio of this case on November 18, 2014.

C. Around 2014, the Plaintiffs requested J, a pro-friendly type of H, to build the instant multi-household housing and studio.

J, in the case of studio in the instant case, directly undertaken new construction works due to small scale. However, in the case of multi-household houses in the instant case, the newly built construction works were carried out under the name of K Co., Ltd. (hereinafter “K”) that it had served as outside directors due to the need for comprehensive construction licenses in its size.

J, after commencing the floor construction of the instant multi-household housing and studio, requested the Defendant, who was engaged in the facility construction business in the name of L around the end of February 2014, for the instant multi-household housing and studio construction work (hereinafter “instant construction”).

Accordingly, the Defendant was involved in the construction of multi-household housing and studio in the instant case, and received KRW 72,240,350 in total from J and K.

E. In the case of the instant multi-household A, the sewage pipes and miscellaneous water pipes of the bathing rooms in the design drawings for the balcony and bathing rooms for each household should be connected to the pipe duct (PD) in the balcony, and the miscellaneous water pipes of the balcony should be connected to the water pipes in the toilets of the toilet through the main diameter of the balcony. The location of the pipe duct was transferred to the bath room. The balcony was installed only in the balcony, and the miscellaneous water discharged from the balcony was connected to the above excellent pipes, not the water pipes.
