1. No person, other than the Seoul Olympic Sports Promotion Foundation or an entrusted business entity, shall issue sports promotion betting tickets or similar things to provide property or property benefits to persons who win at the betting results;

그럼에도 불구하고 피고인은 2018. 1. 8.경부터 2018. 7. 1.경까지 인도네시아 이하 불상지에서 성명불상자(위챗 대화명 ‘B')와 공모하여, 위 성명불상자는 도박사이트를 운영하기 위한 대포계좌를 관리하는 역할을, 피고인(위챗 대화명 ‘C’)은 도박사이트 운영 수익금을 현금으로 인출하는 역할을(소위 ‘환전’) 담당하기로 하고, 도박사이트 운영 사무실을 마련한 다음 ‘D(E)’라는 이름의 사설 스포츠 토토 도박사이트를 개설하여 위 사이트의 회원으로 가입한 도박자들로부터 대포계좌로 송금받은 도금을 그 금액 상당의 게임머니로 교환하여 주고, 회원들로 하여금 국내외 각종 스포츠 경기 등의 승패를 예측하여 위 게임머니를 베팅하게 하여, 그 예상이 적중할 경우 정해진 배당률에 따라 게임머니를 추가로 부여하고, 그 예측이 빗나가는 경우 베팅한 게임머니를 몰수하며, 회원의 환전 요청이 있는 경우 남은 게임머니에 상당하는 금원을 회원이 지정한 계좌로 송금하는 등의 방법으로 도박사이트를 운영하였다.
