2. Where the defendant does not pay the above fine. < Amended by Presidential Decree No. 16093, Jan. 1,

Around April 30, 2013, the Defendant stated that “The Defendant would deposit an amount equivalent to the purchase price at the time of settling an item through Tmond Ammond by accessing the game app called C with a smartphone and with a password “D” after installing it in a smartphone” with the victim B.

However, even if the defendant let the victim settle the small amount of smartphone as above, the defendant was issued cash on the pretext of the discount price from the advertising company and did not have the intent or ability to transfer the cash to the victim.

Accordingly, the Defendant, by deceiving the victim as above, had the victim settle an item amounting to KRW 495,00 and received the amount equivalent to the amount from the victim as a discount price.

From that time to August 24, 2013, the Defendant acquired property benefits equivalent to KRW 2,365,000 in total on five occasions, as shown in attached Table 1, as well as in attached Table 1.

The Defendant, around October 10, 2013, posted a false statement to the effect that “a person would engage in a work loan” on the Internet NAV website at a non-permanent place (hereinafter referred to as Changwon-si) and then sent a false statement to the victim E, who contacted the victim E, stating that “a person who has good credit may be allowed to work for those who have good credit, and a person who would be allowed to receive a loan of KRW 1.50,000,000,000,000,0000,000 won.”

However, even if the defendant receives money from the victim as a fee, he did not have any intention or ability to get a loan.

Accordingly, the Defendant, by deceiving the victim as above, received KRW 50,00 from the victim through the account (FF) used by the Defendant under the pretext of the loan fee.
