E. On February 13, 2013, the Daejeon Occupational Disease Determination Committee determined that the deceased’s disease was not recognized as an occupational disease under the Industrial Accident Compensation Insurance Act, on the ground that “A hazardous substance known to be related to dysia is asbestos, slope, radiation, etc. according to the results of the instant epidemiological investigation, but it is judged that the risk of dysium is low since the said substance was not treated in the process in which the deceased’s work was conducted, and there is no objective ground for the deceased’s exposure to the toxic substance known as hazardous factors at the workplace, and it is difficult to recognize a proximate causal relation between the deceased’s death and the work.”

F. On February 15, 2013, the Defendant decided on February 15, 2013 to pay the Plaintiff’s survivors’ benefits and funeral expenses according to the result of the judgment rendered by the Daejeon Committee for Determination of Occupational Diseases (hereinafter “instant disposition”).

2. Whether the instant disposition is lawful

A. The plaintiff's assertion

The Deceased was regularly exposed to harmful chemical substances, such as dynasium and washing agents, while performing his/her duties at the workplace, and continuously exposed to harmful chemical substances emitted from neighboring processes. In particular, the volatile organic substances discharged at the time of the heating of dynasium were included in the dynasium and reproductive toxic substance, and among which the dynasium was deemed related to dynasium cancer. In addition, the Deceased had been in shift for more than six years, and the Deceased had a long-term shift work, and there was a result that the risk of dynasium outbreak is high compared to those of those women who did not.

B. Facts of recognition

D) Evaluation of business relevance

In the connection process of ○○, it is judged that there is a possibility that a certain work (such as the replacement of gold lines, etc.) might be inhaled into the climatic products handled in the previous process. However, only only some of the heat decomposition products of the climatic dusts may cause the toxicity of the engine such as functional charging, etc. to the climatics, and there is no basis for cancer.

C. Determination

1) The term "occupational accident" under Article 5 subparagraph 1 of the Industrial Accident Compensation Insurance Act refers to an accident caused by an employee's occupational accident while performing his/her duties, and there is a proximate causal relation between the employee's occupational accident and the accident. In this case, the causal relation between the employee's occupational accident should be proved by the assertion. However, with respect to the degree of causal relation, it is not necessarily required to be proved in medical or natural science, and it should be determined by the proximate causal relation from a normative point of view. Therefore, in light of all the circumstances, such as the worker's health condition at the time of employment, development circumstance, details of the disease, the process of treatment, whether there is a cause of the outbreak in the workplace, whether there is a proximate causal relation between the occupational accident and the accident, and whether there is a proximate causal relation between the occupational accident and the accident should be determined on the basis of the worker's health and physical condition, not the average person (see, e.g., Supreme Court Decisions 9Du1424, May 12, 2000>

2) In the instant case, in light of the following circumstances known by the above facts, even if the deceased did not have clearly identified the causes and the generated mechanism of the incurable cancer to the deceased, it appears that the deceased had been continuously exposed to a hazardous chemical for a considerable period of time while working in the gold line connection process at the instant work site, and for a considerable period of time, it appears that stress was accumulated, and it is reasonable to view that such harmful factors were combined, and that the disease occurred in the left-hand form due to the recurrence or aggravation of the disease, and that there was a proximate causal relation between the disease and the work of the deceased. Accordingly, it is presumed that there was a proximate causal relation between the deceased's disease and the work. As the deceased died after the death of the deceased due to an occupational disease, the deceased's death is deemed to constitute an occupational accident, and the disposition of this case that different from this conclusion is unlawful.

In full view of the content of the instant epidemiological investigation report, each fact-finding result, Nonparty 2’s statement (Evidence A9), etc., it is determined that the content of Nonparty 2’s statement is reliable, and that EN-4065, 8351C, etc. was used due to the climatic contact with the above EN-4065, 8351C.

The components of EN-4065 contain nitrophyde and biphenyls; they constitute nitrophydecides; and they correspond to nitrophyde (it is difficult to recognize a direct relationship between reproductive toxic substance and nitrophyde, even if it is difficult to recognize a direct relationship between reproductive toxic substance and nitrophy, the reproductive toxic substance may have a harmful impact on bruto cell, which is the reproductive institution. 8351C component elements are toxic substances harmful to human body and substances whose reproductive cell transitionability is also applicable to substances included in the composition of 8351C.

In addition, it is known that there is a possibility that materials, such as 4-V CDs, can be emitted entirely from the heat decomposition products used in the chip contact process of semiconductor plant, and the possibility of discharge in this case can not be entirely ruled out (Although the epidemiological investigation of this case was judged differently, 6 (a) below will also be examined).

(b)one kind of gold content used in the connection process of the gold lines include not less than the amount of gold, and the amount of gold also constitutes a rock material;

Furthermore, at the time of the instant epidemiological investigation, no particular investigation was conducted on the concentration of the foregoing substance, and the working environment measurement on harmful factors was conducted during the air. 6. The results of the instant epidemiological investigation, based on which the instant disposition was based, seems to have the following problems.

In addition, the epidemiological investigation of this case is a compound with vinyl 4-V CD and 4-VCH, and it seems difficult to produce them as simple heat decomposition products without adding any other substance to AG-Epoxy. However, in the case of the instant Eppoping agents, various materials, such as DNA ethyleneglycerine acid, (crochloroethyl) throthroid, and biphenyls of biphenyls, are included, and thereafter, they go through the process of lighting at the high temperature with the dide presses or re-high temperature from the gold line connections, and it is not reasonable to conclude that there is a possibility that the instant Epoping agents may cause chemical reaction with the components of the dropher (including wafer) and the dropic agents in semiconductor process, and that there is no possibility that the instant Epoping agents might cause any occurrence of 4-V-V-N without any specific ground for the use of the droping agents in semiconductor process.

(c) While the instant epidemiological investigation was conducted more than 10 years after the Deceased’s work performed, it is difficult to accept the conclusion that it is difficult to view that it was exposed to substances related to dysium, without conducting working environment measurement of harmful factors in the air on the ground that asbestos, sloping, etc. generally known as substances causing dysium cancer, or radiation is not being used in the process when the Deceased worked (if harmful factors were discovered at the time of the instant epidemiological investigation, it can be presumed that such harmful factors were much higher than the time when the Deceased worked).

d) In light of the work relevance assessment report, etc. submitted by the Plaintiff, it is also difficult to accept that the epidemiological investigation conducted on part of the results of an epidemiological investigation on semiconductor industry workers did not find out that the risk of infertility and death was significantly higher than that of the general population group.

7) There is a possibility that hemmons might be disturbed, such as Melin, etc., which may cause skin and stress or which has the effect of controlling cancer growth, due to the depression, lack of water surface, life rhythy and rhythrhym of living during a night-time shift. Thus, the disease itself may have a negative impact on the outbreak and aggravation of the disease by stimulating, or undermining the physical immunodeficiency force of the skin or accumulated skin and stress.

The Plaintiff appears to have been under cumulative and stressed over a considerable period of time by engaging in two or three night shifts work within a period of service of 6 years and 2 months. Even if it is difficult to readily conclude that the Plaintiff’s work form served as a direct cause of the instant disease, the relationship between the weekly night shift work and the basin cancer is limited in terms of the climatic classification standard, etc. of the International Cancer Research Institute (see, e.g., Supreme Court Decision 2006Da1548, Apr. 2, 2006). However, it seems that general opinions have been established as to whether there is a direct relationship between the weekly night shift work and the bar cancer work, etc., but it is difficult to see that there is a direct relation between the Defendant’s climatic shift work and the bar cancer work, thereby adversely affecting the

3. Conclusion

Therefore, the plaintiff's claim of this case is reasonable, and it is decided as per Disposition.
