The costs of appeal are assessed against the Plaintiff’s Intervenor, and the remainder are assessed against the Plaintiff.

The judgment below

Examining the reasoning of the judgment below in light of the records, the court below’s reasoning was somewhat inappropriate, but it is acceptable to accept the Plaintiff’s claim on the grounds of its ruling, such as the violation of the political speech and the good faith principle. In so doing, the court below did not exhaust all necessary deliberations, and did not err by exceeding the bounds of the principle of free evaluation of evidence against logical and empirical rules, or by misapprehending the relevant legal principles

Therefore, the appeal is dismissed, and the costs of appeal are assessed against the Intervenor, and the remainder is assessed against the Plaintiff. It is so decided as per Disposition by the assent of all participating Justices on the bench.
