A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Punishment of the crime
No person shall sell or sell marijuana, except where approved by the Minister of Food and Drug Safety, and no person shall smoke marijuana, except where he/she takes marijuana for medical purposes with approval from the Minister of Food and Drug Safety.
1. Trade in marijuana;
A. A. Around December 22, 2019, the Defendant: (a) collected money with B; (b) decided to purchase the hemp plant (hereinafter “marine marijuana leaves”) from the seller of marijuana who was unable to know his/her name through the telegram Messenssens, and (c) received KRW 100,000 from B; and (d) transferred KRW 370,000 to the account (F) in the name of E used by the seller of marijuana who was unable to know his/her name in the account (D) at around 17:48 of the same day; and (d) received a quantity of marijuana in which it is impossible to identify his/her name at any place located in the pre-masia designated by the seller of marijuana.
(A) The Defendant: (a) sold marijuana equivalent to KRW 3,70,000, in collusion with the Minister of Food and Drug Safety, even if the Defendant did not obtain approval from the Minister of Food and Drug Safety.
B. The Defendant, around 16:45 on January 27, 2020, decided to purchase approximately 5g of marijuana from a hemp seller who was unable to know his name through the telegram Megssenssenssenssenssenssenssenssenssenssens, and the above A
