1. The Defendant shall pay to the Plaintiff KRW 41,00,000 and the interest rate of KRW 15% per annum from March 27, 2017 to the date of complete payment.
If the purport of the entire pleadings is added to the statement or image of Gap evidence 1 through 3, the plaintiff lent a total of KRW 85 million to the defendant from around 2012 to around 2014, and the fact that the repayment period has already lapsed around 2015 can be acknowledged, and the fact that the above loan was returned from the defendant is the plaintiff.
Therefore, the Defendant is obligated to pay to the Plaintiff damages for delay at the rate of 15% per annum under the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings from March 27, 2017 to the day of full payment, as requested by the Plaintiff, on the day following the delivery date of a copy of the instant complaint, as sought by the Plaintiff.
The plaintiff's claim is reasonable, and it is so decided as per Disposition.
