A. On September 20, 2017, the Plaintiff received a subcontract from the Defendant during the period from September 20, 2017 to November 10, 2017 by setting the construction cost of KRW 209,00,000, and the construction period from September 30, 2017 to November 20, 2017.

On December 13, 2017, the Plaintiff received requests from the Defendant for additional construction works in accordance with the design change of the said construction works on two occasions, and the additional construction cost is KRW 25,840,000 (hereinafter “second construction works”) between the Defendant and the Defendant and KRW 28,80,000 (hereinafter “third construction works”).

(C) Around January 2018, the Plaintiff agreed to each of the above construction works. However, the Defendant paid the Plaintiff KRW 188,00,000 as the first construction cost, and KRW 17,40,000 as the third construction cost. D. Accordingly, the Defendant is obliged to pay the Plaintiff the remainder of the construction cost of KRW 58,240,00 (=209,000,000 for the first construction cost) - KRW 188,000 for the second construction cost of KRW 25,840,000 for the second construction cost of KRW 28,80,000 for the third construction cost of KRW 28,80,00 for the third construction cost of KRW 17,40,00 for the last construction payment - from July 5, 2018 to the date following the date following the delivery of a copy of the complaint of this case, and damages for delay under Article 2515(1)5(2) of the Civil Procedure Act.
