3. 피고인은 2018. 2. 17. 12:30경 경북 의성군 D에 있는 ‘E’ 사무실에서, 피해자가 설날에 집에 가겠다고 말했다는 이유로, 피해자에게 “이 씹할 년아, 왜 너 멋대로 집에 가려고 하냐!”라고 욕설을 하며, 손바닥으로 피해자의 뺨을 때리고, 주먹으로 피해자의 머리와 가슴을 때리고, 발로 피해자의 다리를 걸어 넘어뜨린 후 피해자의 머리를 바닥에 찧고 발로 피해자의 가슴을 밟았다.
