Examining the evidence of the first instance court’s adoption maintained by the lower court, it is justifiable to find the lower court guilty of attempted fraud and aiding and abetting in the instant charges on the grounds stated in its reasoning.

In so doing, contrary to the allegations in the grounds of appeal, there are no errors of misapprehending the rules of logic and experience to recognize facts.

Further, among the grounds of appeal, the ground of appeal that the defendant did not consider it as the grounds of appeal or that the court below did not consider it as the subject of ex officio is not a legitimate ground of appeal.

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
