However, the lower court’s sentencing is not deemed unfair in light of the following: (a) there is no particular change in the sentencing conditions compared to the lower court; (b) the Defendant was the first offender who has no criminal history; and (c) the circumstances leading to the instant case and various sentencing conditions specified in the instant records and arguments.

Therefore, the prosecutor's appeal is dismissed.
