The judgment below

Examining the evidence duly adopted by the court of first instance, the court below’s determination that the charge of this case was guilty on the grounds stated in its reasoning is just, and contrary to the allegations in the grounds of appeal, the court below did not exhaust all necessary deliberations but exceeded the bounds of the principle of free evaluation of evidence and exceeded the bounds of logical and empirical rules, or did not err by misapprehending the legal principles on fraud.

In addition, the remaining grounds of appeal that the facts charged are not properly specified are not legitimate grounds of appeal, as alleged in the grounds of appeal by the defendant, or by the court below that the defendant did not consider it as the subject of judgment ex officio.

In addition, even if the record is examined, there is no illegality as alleged.

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
