Punishment of the crime
1. Defendant A is the representative director of the B Co., Ltd. located in Ansan-si Group C, who is an employer who conducts manufacturing business using 16 full-time workers.
A worker dispatch business shall be limited to the business prescribed by Presidential Decree, which is deemed appropriate in consideration of the expertise, technology, experience, or the nature of business, except for the direct production process of the manufacturing business, and the direct production process of the manufacturing business shall be limited to the case where a vacancy occurs due to childbirth, disease, injury, etc. or where it is necessary to secure human resources temporarily and intermittently, and no person shall be provided with labor for the dispatched business in violation of this provision.
Nevertheless, as indicated in the list of crimes in the attached Form, the above Defendant was dispatched from three dispatched companies from April 29, 2014 to May 31, 2015, 222 persons, including D, from L, L, L, and L, from January 24, 2015 to June 30, 2015, 69 persons, including E, from L, and 69 persons from L, L, and E, from June 1, 2015 to June 7, 2015, 8 workers, including F, were dispatched from three dispatched companies, to whom 9 workers were dispatched, and there was no reason to temporarily or intermittently secure human resources from manufacturing companies.
2. Defendant B Co., Ltd. is a corporation established on January 5, 2007 with its head office located in the above location for the purpose of manufacturing business, etc.
If the representative of a corporation, or an agent, employee or other servant of the corporation or an individual commits an offence under Article 43 of the Act on the Protection, etc. of Workers in connection with the business of the corporation or the individual, not only shall such offender be punished, but also the corporation or the individual shall be punished by
Provided, That in order to prevent such violation, it shall be reasonable for a corporation or an individual to perform the relevant duties.
