On November 22, 2012, the Defendant was sentenced to ten months of imprisonment with prison labor at the Incheon District Court for fraud, etc., and the judgment became final and conclusive on December 6, 2012.

1. Fraud;

A. On November 15, 2010, the Defendant made a false statement to the effect that the victim D’s house located in Seo-gu, Seo-gu, Seo-gu, Gwangju, 101 Dong 801, would make an investment in the scke golf course business, and that the victim would make a profit with an investment in the scke course business.

However, there was no special property at the time, but there was about KRW 40 million, and there was no intention or ability to pay profits even if they were to receive the money from the victim or to use it as a cost of living.

As such, the Defendant, by deceiving the victim, received 10 million won from the victim to the bank account used by the victim for the same day as the investment money, and subsequently, acquired 52,570,000 won in total over 10 times from June 17, 201, as shown in the separate crime list, from the time to June 17, 201.

B. On November 2010, the Defendant made a false statement to the effect that “If a credit card is lent, the Defendant would make a timely payment to the victim D,” at the Defendant’s house located in Seo-gu, Seo-gu, Gwangju, 103 701, Seo-gu, Gwangju.”

However, there was no special property at the time, but there was about 40 million won and there was no intention or ability to pay the payment properly even if the credit card was lent from the victim.

The Defendant, by deceiving the victim, obtained the victim’s national card from around that time, and thereafter, obtained the victim’s national card from that time until July 10, 201, used the above credit card in order to purchase goods, etc., and acquired the remainder of KRW 5,123,717 among them by settling the remainder of KRW 7,957,041, in a manner that does not settle the remainder of KRW 7,957,041.
