Punishment of the crime
On July 31, 2019, the Defendant is the owner of Kuwon-si B Building C Officetel, and the victim D (n, 25 years of age) entered into a contract with the Defendant on July 31, 2019, stating that “The term of lease is from July 31, 2019 to July 30, 2021 (24 months), deposit is KRW 160 million, down payment is paid at the time of the contract, and the remainder is paid in KRW 140 million on July 31, 2019, and the person who occupies the said officetel from July 31, 2019.”
On or around August 1, 2019, the Defendant: (a) stated in the indictment of licensed real estate agents E, a broker of the foregoing charter contract, “F,” but according to the records, it appears to be a clerical error in the victim’s licensed real estate agent E; and (b) even if it is corrected without any amendment process, it does not result in any substantial disadvantage in the Defendant’s exercise of the right to defense; and (c)
The agreement on the removal of a facility and the burden of installation costs are additionally stated in the contract already completed, and the defendant's mobile phone is taken to photograph this, thereby opening 5 gates in a locking device installed at the studio of the above studio, thereby preventing the victim from entering the studio.
As a result, the defendant took possession of the above officetels owned by the defendant, which is the purpose of the victim's possession, and obstructed the victim's exercise of rights.
