The grounds of appeal are examined.
For the reasons indicated in its holding, the lower court reversed the judgment of the first instance that found Defendant B guilty of the violation of the Act on the Control of Narcotics, Etc. among the facts charged in the instant case against Defendant C, Defendant E, and Defendant F on the ground that there was no proof of the criminal intent, and affirmed the judgment of the first instance that acquitted Defendant C, Defendant E, and Defendant F on each of the facts charged in the instant case on the ground that there
Examining the record in accordance with the relevant legal principles, the lower court’s aforementioned determination is justifiable. In so doing, it did not err by exceeding the bounds of the principle of free evaluation of evidence against logical and empirical rules, or by misapprehending the legal doctrine on intentional act in violation of the Narcotics Control
Although the prosecutor appealeds the entire judgment of the court below as to the guilty portion against Defendant B, there is no statement in the petition of appeal or the appellate brief on the grounds of objection.
Therefore, all appeals are dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
