The prosecutor's appeal is dismissed.
1. According to the summary of the grounds for appeal (the misunderstanding of legal principle) and the evidence submitted by the prosecutor, the facts charged can be fully acknowledged.
2. The lower court found the Defendant not guilty on the ground that all the evidence presented by the prosecutor was insufficient to acknowledge the facts charged, and that there is no evidence to prove that the Defendant was the criminal who committed an indecent act against F.
Comprehensively taking account of the circumstances in the reasoning of the court below acknowledged by the evidence, the above judgment of the court below is just, and there is no error of law by mistake of facts as alleged by the prosecutor.
Therefore, prosecutor's assertion is without merit.
3. As such, the prosecutor's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act on the ground that it is reasonable.
