1. The Defendant shall pay KRW 38,836,00 to the Plaintiff the annual rate of KRW 15% from January 8, 2016 to the date of complete payment.

Reasons

In full view of the purport of the argument in Gap evidence No. 1, it is acknowledged that the plaintiff supplied the defendant with 38,836,000 won out of the price of the goods, and it is not paid 38,836,000 won out of the price of the goods. The defendant is obligated to pay to the plaintiff damages for delay at the rate of 15% per annum as stipulated in the Act on Special Cases concerning the Promotion, etc. of Legal Proceedings from January 8, 2016 to the date of full payment, which is obvious that the copy of the complaint in this case was served on the defendant.
