On January 23, 2016, the Defendant: (a) was a female-parent body of a person with disabilities of Grade 3 in intellectual disability, who was a branchr in front of the E office near the D police box located in C at Masung-si on January 23, 2016; (b) provided meals with the victim, who was in a usual sense of view, led the victim to meet the victim’s relative G and H, who was living together with the Defendant, and entices the victim to the office of the Defendant.

피고인은 같은 날 16:00 경 화성시 I 주택 A 동 102호에 있는 피고인의 집에서, 위 G 등이 집에 없는 것을 기화로 피해자를 피고인의 방으로 데리고 간 다음 갑자기 피해자의 몸에 올라 타 “ 하지 말라 ”라고 소리치면서 손과 어깨로 피고인의 몸을 밀어내며 저항하는 피해자의 몸을 힘으로 눌러 반항을 억압한 후, 손으로 피해자의 바지와 팬티를 벗겨 혀로 피해자의 음부를 핥고 피해자의 음부에 손가락을 넣은 다음 피해자를 1회 간음하여 강간하고, 계속하여 그 무렵 위 G, H가 귀가 하자 위 G 등에게 인사한 후 피해자를 다시 피고인의 방으로 데리고 가 피해자의 몸에 올라 타 소리를 지르려고 하는 피해자의 입을 한 손으로 막고, 손으로 피고인의 몸을 밀어내며 저항하는 피해자의 몸을 힘으로 눌러 반항을 억압한 후 피해자를 1회 간음하여 강간하였다.
