건물인도등 청구의 소
1. The money of the court of first instance falling under the following order to pay the money.
Based on the facts, the Defendants, who entered into the instant lease agreement, share 1/2 shares of each of the land and the ground buildings (hereinafter “instant real estate”) listed in the separate sheet.
On November 28, 2013, the Plaintiff entered into a lease agreement (hereinafter “instant lease agreement”) with E with respect to the instant real estate on behalf of the Defendants, as follows:
Real Estate Lease Agreement
1. The lessor and the lessee of the real estate indicated in the following items shall enter into a lease agreement with respect to the real estate indicated in the following:
The total area of 1,860.57 square meters for rental of the area of 1,860 square meters for 394 square meters of a building with a large area of land category of Pyeongtaek-si in Gyeonggi-do and for 394 square meters;
2.With respect to the lease of such immovable property, Article 1 (Purpose) of the Terms and Conditions of the Contract, the lessor and the lessee shall pay by agreement the lease deposit and the rent as follows:
The deposit money of KRW 500,000,000 (Won 500,000,000) deposit money shall be paid and received at the time of the contract. The remainder of the receiver(E) intermediate payment shall be paid on January 7, 2014.
The rent shall be paid on the seventh day of each month after the payment of the rent in full.
Article 2 (Duration) The lessor shall deliver the above real estate to the lessee by January 7, 2014 in a condition that he/she can use or benefit from the said real estate for the purpose of the lease, and the lease period shall be from the date of delivery to the date of 00-year.
Article 3 (Change of Use, Sub-lease, etc.) No lessee shall change the use or structure of the above real estate, transfer the sub-lease or provide the security, nor use it for any purpose other than the purpose of lease without the consent of the lessor.
Article 4 (Termination of Contract) If the lessee fails to pay the rent for a period of two years, or if the lessee violates Article 3, the lessor may terminate the contract without delay.
