1. The decision made by the Intellectual Property Tribunal on September 8, 2016 on the case No. 1309 shall be revoked.

2. The costs of the lawsuit are assessed against the defendant.

1. Basic facts

A. The patented invention of this case is below

As referred to in paragraph (3) of this case, after the trial decision of this case became final and conclusive and the corrective publication was made; hereinafter “the patented invention prior to the correction”; and hereinafter “the patented invention of this case” of this case. (No. 18) The name of the invention: X-type (Excim) refers to the original state in which the energy is the lowest in xcim, and two moleculars formed by one original state in which the energy is the highest in xcim.

EXS lamps are lamps filled with adequate X-ray gas in a discharge line made of tin glass, using light emitting in the event of discharge into a low-end State with X-ray.
