In light of the evidence adopted by the court of first instance maintained by the court below, it is just to find the court below guilty of the facts charged in this case on the grounds as stated in its reasoning. Contrary to the allegations in the grounds of appeal, the court below did not err by misapprehending the rules of logic and experience or by misapprehending the rules of evidence or by violating the principles of due process or presumption of innocence.

Meanwhile, the argument that the court below erred in omitting judgment as to the jurisdiction of criminal investigation is not a legitimate ground for appeal, as it is alleged in the ground of appeal that the defendant did not appeal or that the court below did not consider it as a subject of judgment ex officio.

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
