On December 23, 2010, the Busan District Court sentenced Defendant A to a suspended sentence of one year and six months, Defendant B was sentenced to a suspended sentence of two years and two years of suspended sentence of one year and one year of imprisonment, and the above judgment became final and conclusive on December 31, 2010.

Defendant

A is the substantial representative of the (ju) E, who is a planning real estate company, for the purpose of real estate sale in the 3th floor of the D building in the Busan Metropolitan Government, and Defendant B was a person who had been working for the entire business of the (ju) E.

1. The Defendants made a false statement to the victim F at the (State) EE office around July 2009, stating, “I wish to purchase from our company the 3,178 square meters of G forest land in Ulsan-gun, Ulsan-gun, Ulsan-gun, which is close to the KTX Station and located in the urban planning, and will immediately transfer the name when purchasing part of the forest land.”

However, there was no intention or ability to purchase the land and to complete the registration of ownership transfer to the victim even if the land is paid with money from the victim because there was no funds to purchase the G land.

On July 16, 2009, the Defendants conspiredd the victim as above, and conspiredd the victim with the victim, and acquired KRW 2,00,00,000 as the down payment for approximately 330 square meters of the above forest as part of the above forest land, and acquired KRW 14,660,000 in total from the Busan Bank Account (number I) in the name of EH on July 23, 2009 to the balance, and acquired KRW 16,660,00 in total.

2. On July 28, 2009, the Defendants made a false statement to the victim J as provided in paragraph (1) at the (ju) E office.

However, there was no intention or ability to purchase the land and to complete the registration of ownership transfer to the victim even if the land is paid with money from the victim because there was no funds to purchase the G land.

On July 28, 2009, the Defendants conspired as above, by deceiving the victim and deceiving it from the victim, KRW 1,400,000 as the down payment for approximately 330 square meters, part of the above forest land, and KRW 17,60,000 on August 12, 2009 as the remainder payment, and KRW 19,00,000 in total by receiving the said Busan Bank account from the victim to the Busan Bank account.
