1. The instant lawsuit was concluded on December 12, 2018 as the withdrawal of the lawsuit.
2. The costs of the lawsuit after the completion of the lawsuit.
A lawsuit shall be deemed withdrawn when a person who has raised an objection against a distribution schedule fails to appear on the first date for pleading of a lawsuit of demurrer against distribution (Article 158 of the Civil Execution Act). The fact that the Plaintiff was not present on December 12, 2018, which is the first date for pleading, even after being notified of the date for pleading, is apparent in the record.
Thus, the lawsuit of this case was terminated as the withdrawal order in accordance with the above provisions of the Civil Execution Act.
As such, the declaration of termination of the lawsuit is to be made.
