The costs of appeal are assessed against the Plaintiff.

The lower court, based on the circumstances indicated in its reasoning, determined that it is reasonable to view that the Plaintiff renounced the exclusive and exclusive right to use the said land by dividing the instant land by itself and providing it as a passage for neighboring residents.

In light of the records, the above judgment of the court below is just, and contrary to what is alleged in the grounds of appeal, there were no errors by exceeding the bounds of the principle of free evaluation of evidence against logical and empirical rules or by misapprehending the legal principles on the waiver

Therefore, the appeal is dismissed, and the costs of appeal are assessed against the losing party. It is so decided as per Disposition by the assent of all participating Justices on the bench.
