(4) In light of the above legal principles, the court below erred by misapprehending the legal principles on the grounds of appeal and failing to exhaust all necessary deliberations, contrary to what is alleged in the ground of appeal, it is so decided as per Disposition by the assent of all participating Justices on the bench.
