1. Defendant shall be punished by a fine of KRW 10,000,000;

Reasons

Punishment of the crime

1. A person who intends to produce or distribute a game product for the purpose of distributing game products or providing such game products for use in violation of the Game Industry Promotion Act shall obtain a rating concerning the contents of the game product concerned from the Committee before producing or distributing the game product concerned, and shall not provide such game products for the purpose of distribution or use, or display or keep such game products for such purpose;

Nevertheless, from September 28, 2014 to October 8, 2014, the Defendant installed 34 computers in which “sea-to-sea-to-sea-to-sea-to-door games,” which were not classified by the Game Rating Board from around the permanent residence B and the first floor from around October 2014, and provided them to many and unspecified customers.

Accordingly, the defendant distributed unclassified game products.

2. No person shall exchange, arrange for exchange or repurchase any tangible or intangible outcome (referring to game money prescribed by Presidential Decree and things similar thereto prescribed by Presidential Decree, such as score, premiums, and virtual currency used in game) acquired through the use of game products by himself/herself as a business.

When the defendant pays cash to the defendant at the same time and place as provided in the preceding paragraph, the defendant shall pay a card with which the corresponding points are accumulated to the defendant, and where the defendant puts it into a game machine to practice the game, and where the defendant gets a good flag from the game screen, he/she shall be entitled to accumulate the corresponding points.

As above, the Defendant exchanged in cash the amount calculated by deducting 10% from the par value of points, which is the result of the acquisition by customers through the use of game products.

Accordingly, the defendant obtained results through the use of game products.
