The application for compensation order of this case shall be dismissed.

Since 2014Gohap164, 2014Gohap183 is the same criminal facts, it shall be stated together.

Defendant

A and B from April 8, 2014 to operate the “I gas station” located in the G of the Masung-gun, Jeonsung-gun, and the J has the technology to install “facilities that can steals petroleum” on the oil pipelines, and K and Defendant C play the role of helping the above J to install the said devices.

At the end of April 2014, the Defendants stolen oil from the oil pipelines installed in the vicinity of the oil station at the end of the above dopco, which passed the oil pipelines by installing the above facilities, to “in the event that oil pipelines and oil stations are connected, each oil tank of the oil pipelines and oil stations are installed in the oil pipelines, open valves installed in the oil pipelines to confirm the kind of oil flow, and then store oil from the oil pipelines via the oil pipelines to the oil tank.” After selling oil from the oil tanks installed in the tank storing the relevant oil to the oil tank, the Defendants conspired to divide profits therefrom.

Accordingly, from early May 15, 2014 to June 13, 2014, Defendant A reported the network, and J, K, and Defendant C cut away from the bottom of the oil station to the oil pipeline, and installed pressure sprinks, pressure gauges, and valves on the oil pipeline. Defendant B installed the aforementioned facilities using the said facilities to dump truck and disposed of wastes, such as soil generated in the course of installation. From June 15, 2014 to June 26, 2014, the market price of 44,640,00 won owned by the victim, and 63,460,000,000 won via the market price and 38,000 liters within the oil tank respectively.

Accordingly, the defendants are entitled to the victim's property by installing facilities to steal oil in the oil pipelines together with J and K.
