1. Basic facts
A. (1) On March 29, 2012, the Plaintiff was a company running an insurance business, etc., and the name of the Plaintiff was changed from the Green Cross Life Insurance Co., Ltd. as of March 29, 2012. (2) On March 17, 2006, the designated parties, who were children of the Defendant (designated parties; hereinafter “Defendant”), entered into an insurance contract with the Plaintiff as the insured concurrently as the beneficiary (hereinafter “instant insurance contract”).
3 On August 31, 2009, the policyholders and beneficiaries of the instant insurance contract were replaced by the defendant in the designated party upon the application of the defendant and the designated party.
B. The selector of the insurance money based on the instant insurance contract received hospitalized treatment, etc. from around June 2008 as indicated in the following table. Based on the instant insurance contract, the Plaintiff received KRW 3,553,873 from the Plaintiff, the selector, and the Defendant received KRW 28,765,021 from the Plaintiff.
The beneficiary of the insurance money to be paid for the period of hospitalization of the hospital is 1 Busan University on June 6, 2008 and 1st.
