The prosecution of this case is dismissed.
Reasons
1. On July 29, 2016, at the main point of “C” located in Gangdong-gu Seoul Metropolitan Government around 01:30 on July 29, 2016, the Defendant assaulted the victim by cutting down and pushed down the bomb of the victim on the ground that the victim D (year 64) was drinkingly.
2. Determination
(a) Crimes of non-compliance with will: Article 260 (3) of the Criminal Act;
B. Withdrawal of wishing to punish the victim on September 2, 2016, which was subsequent to the institution of public prosecution
(c) Judgment dismissing public prosecution: Article 327 subparagraph 6 of the Criminal Procedure Act;
