A defendant shall be punished by imprisonment for six months.
However, the execution of the above sentence shall be suspended for a period of one year from the date this judgment becomes final and conclusive.
Punishment of the crime
1. Violation of the Act on Special Cases Concerning the Settlement of Traffic Accidents (Bodily Injury) is a person engaging in driving service of B Poter Cargo Vehicles (hereinafter “instant Cargo Vehicles”).
On May 23, 2018, the Defendant driven the instant cargo without obtaining a driver’s license of the instant vehicle, and led the instant truck to drive approximately 40km at a speed of about 10km, depending on one lane from the direction of the training market to the direction of the DNA in Daegu Suwon-gu C.
At the time, there was a soil condition in front of the Del, and there was only one lane, so in such a case, the person engaged in driving a motor vehicle has the duty of care to prevent the sudden collision by maintaining a sufficient safety distance and driving a motor vehicle in order to avoid the soil pressure above the road.
Nevertheless, the Defendant neglected to do so and found up the soil conditioners on the front side of the Doel road before the instant cargo, and did not secure a sufficient safety distance even though the Defendant failed to stop to drive the instant cargo, and received a part behind the instant cargo vehicle driven by the victim E with the front part of the instant cargo driving by the victim E as the front part of the instant cargo, which was driven by the victim E.
Ultimately, the Defendant suffered, by such occupational negligence, the injury to the victim E, such as salt, tensions, etc. in light of the influence that requires approximately two weeks of medical treatment, and the injury to the victim G (V, 62 years of age) who is a passenger of K7 car, for approximately two weeks of medical treatment.
2. On May 23, 2018, the Defendant, without obtaining a driver’s license, driven the instant cargo vehicle with approximately KRW 500 meters of freight on the front of the DNA Doldong in Daegu Suwon-gu, Daegu-gu, about 11:10 on May 23, 2018.
