피고인은 2015. 2. 9. 10:00경 청주시 청원구 D에 있는 피해자의 집에서 피해자로부터 받기로 한 20만 원 중 받지 못한 18만 원을 달라고 피해자에게 말하였으나 피해자가 피고인이 군위로 내려가면 돈을 보내주겠다고 말하면서 서로 말다툼을 하였고, 피해자가 마침 찾아온 택배기사에게 말하여 신고하겠다면서 밖으로 나가자, 화가 나 피해자를 따라 나가 피해자의 상의를 잡고 피해자를 방안으로 끌고 들어와 밀쳐 넘어뜨린 후, 주먹으로 피해자의 목, 머리, 허벅지 부위를 약 10회 때리고 발로 피해자의 허벅지 부위를 약 5회 걷어찼다.
