The prosecution of this case is dismissed.
Reasons
1. Around 04:50 on July 6, 2016, the Defendant assaulted the victim D(39 years of age) two times in front of the convenience store located on the first floor of the Seongbuk-gu building B, Sungwon-si, Sungwon-si.
2. Determination
(a) Provisions of applicable provisions to charges: Article 260 (1) of the Criminal Act;
(b) Crimes of non-compliance with will: Article 260 (3) of the Criminal Act.
(c) The injured party shall express his intention not to want the punishment of the accused after the prosecution is instituted;
(d) Judgment dismissing public prosecution (Article 327 subparagraph 6 of the Criminal Procedure Act);
