The judgment below

Examining the reasoning in light of the evidence, the lower court reversed the first instance judgment that acquitted the Defendant on the grounds of its stated reasoning, and sentenced the Defendant guilty of the modified facts charged.

Examining in light of the relevant legal principles and evidence, the lower court did not exhaust all necessary deliberations as alleged in the grounds of appeal, and did not err by misapprehending the legal principles on the duty of care of automobile drivers or by misapprehending the rules of logic and experience.

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
