1. 피고인 A, 피고인 B의 공동범행 2008. 4.경 L은 한국서부발전(주)와 버너노즐팁 등 부품 9종에 대한 물품구매계약을 체결하였는데, 동 물품구매계약 입찰 공고사항에 의하면 ‘품명과 규격’은 첨부된 자재구매규격서 또는 품목명세서에 따라야 하고, 자재구매규격서, 물품구매(제조)계약 일반조건 등에 의하면 화력발전소에 납품되는 품목들에 대해서는 당해 물품을 납품할 때 그 물품이 KS 규격에 맞아야 하며, 위 물품이 KS 규격 기준치를 충족한다는 사실이 확인되는 시험성적서, 품질매뉴얼, 공장시험 검사계획서 및 절차서 등 품질보증서류를 제출하도록 되어 있고, 기준치에 미달되는 경우 납품하는 부품의 수령을 거부할 수 있으며, 납품기일 지체에 따른 지체상금을 납품업체에서 추가로 부담하도록 규정하고 있었다.
