1. The Defendant: KRW 9,458,350 for the Plaintiff and KRW 5% per annum from February 1, 2017 to February 9, 2018; and
Approval and Public Notice of the process of adjudication - Railroad Construction Project (B): Public Notice of the Ministry of Land, Infrastructure and Transport - Project operator: The adjudication on expropriation on December 8, 2016 by the Central Land Expropriation Committee (hereinafter referred to as "D land") - The expropriation date of each land listed in the separate sheet (the land shall be specified in the same manner as "D land") - Compensation: January 31, 2017 - The adjudication made on May 25, 2017 (hereinafter referred to as "the adjudication in this case") by the Central Land Expropriation Committee of KRW 659,308,650 (hereinafter referred to as "the adjudication in this case"): The compensation amount in this case shall be increased to KRW 678,703,650 (based on recognition) - The pertinent adjudication shall be made in the absence of any dispute; the purport of each entry in the separate sheet of subparagraphs 1 through 3; the purport of each entry in the separate sheet of appraisal and assessment as well as the overall compensation amount of each of the land in this case;
Judgment
Article 7(1) of the Rules on the appraisal of whether or not the instant land should be comprehensively assessed shall be individually assessed for each subject matter, and Article 7(2) of the said Rules provides that where two or more subject matter are traded in one unit or where there is an indivisible relationship between subject matter and each other for the purpose of use, an assessment may be conducted collectively.
Here, whether a “inseparability relationship for use” refers to a case in which a situation used as a group of land is deemed reasonable and reasonable in terms of social, economic, and administrative aspects and the formation of the value of the land.
